Terms of Service

These Terms are a binding agreement between you and ZestyShot LLC (“ZestyShot”, “we”, “us”). They cover the ZestyShot iOS app and our websites at zestyshot.com and m.zestyshot.com. By using ZestyShot you agree to these Terms and to our Privacy Policy. If you do not agree, do not use ZestyShot.

ZestyShot is in a pre-launch period. Features may change, break, or disappear while we iterate.

You must be at least 13 years old to use ZestyShot. If you are under the age of majority where you live, you may use ZestyShot only with the involvement of a parent or guardian who agrees to these Terms. By using ZestyShot you confirm that you meet these requirements.

Every install starts with an anonymous account tied to your device. You can optionally sign in with Apple or Google to keep your reels if you switch devices or reinstall the app. You are responsible for activity that happens under your account and for keeping access to your sign-in method. Tell us promptly if you believe your account has been compromised.

“Your content” means the videos you upload, the reels we render for you, and any titles or captions you add.

You keep all ownership and rights in your content. We do not claim ownership.

To run the service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, process, transcode, analyze, and render your content, and to deliver it back to you — and, when you choose to publish a reel, to display and stream that reel on its public watch page. This license exists only so we can operate ZestyShot for you, and it ends when you delete the content or your account, except for copies in routine backups for a limited period.

We do not use your content to train AI models, and we do not use it for advertising or sell it.

You are solely responsible for the footage you upload. By uploading content you confirm that:

• you have the right to record, upload, and share it;
• you have any consent needed from people who appear in it — and where it shows minors, you are their parent or guardian or have permission from one;
• it does not infringe anyone's intellectual property, privacy, or other rights;
• it is not unlawful or harassing, and was not recorded somewhere or in a way that required permission you do not have.

We do not pre-screen content, but we may remove content or suspend accounts that we believe violate these Terms or the law.

When using ZestyShot you agree not to:

• upload content you do not have the right to use;
• record or share people who have not agreed to be filmed;
• break, overload, probe, or reverse-engineer the service, or try to access it in unauthorized ways;
• scrape or bulk-download content, including public watch pages;
• resell or commercially exploit the service without our permission;
• use ZestyShot to break the law or infringe others' rights.

Publishing a reel creates a public watch page reachable by anyone with the link, with no sign-in required. You decide whether and what to publish. You can revoke a share link at any time from the app, but copies viewed or saved while the reel was public may still exist. Do not publish reels containing people who have not agreed to appear publicly.

ZestyShot relies on services from Apple, Google, and others. Your use of those features may also be subject to the third party's terms. We are not responsible for third-party services.

ZestyShot — including the app, websites, software, the “ZestyShot” name, logo, and design — belongs to ZestyShot LLC and is protected by intellectual-property laws. These Terms do not give you any right to use our branding without our written permission. Finished reels we render for you are yours to keep and share, subject to these Terms.

ZestyShot is provided “as is” during pre-launch. We may add, change, pause, or remove features at any time, and we may limit or interrupt the service for maintenance or other reasons. We aim to keep your data safe but cannot guarantee uninterrupted or error-free service, or that every reel will render the way you expect.

You can stop using ZestyShot and delete your account at any time from the app. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the service. Sections that by their nature should survive termination — including content licenses for residual backups, disclaimers, limitation of liability, and governing law — survive.

To the fullest extent permitted by law, ZestyShot is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that footage analysis will identify every highlight or do so accurately.

To the fullest extent permitted by law, ZestyShot LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, reels, or footage. Our total liability for any claim relating to ZestyShot will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

You agree to indemnify and hold harmless ZestyShot LLC from claims, losses, and expenses arising out of content you upload or publish, your use of ZestyShot, or your violation of these Terms or the rights of others.

These Terms are governed by the laws of [GOVERNING LAW], without regard to its conflict-of-laws rules. Any dispute relating to ZestyShot will be resolved in the courts located in that jurisdiction, and you consent to their jurisdiction. Nothing here removes any consumer-protection rights you have under the law where you live.

We may update these Terms as ZestyShot evolves. When we make material changes we will update the effective date above and, where appropriate, notify you in the app. Continued use after a change means you accept the updated Terms.
